CIRCULAR
PROMULGATING THE NOMENCLATURE OF MEDICAL EQUIPMENT WHOSE HS CODES HAVE BEEN ASSIGNED IN THE VIETNAM’S NOMENCLATURE OF EXPORTS AND IMPORTS
Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Health;
Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 providing specific provisions and guidance on enforcement of the Customs Law on customs procedures, examination, supervision and control procedures;
Pursuant to the Government’s Decree No. 36/2016/ND-CP dated May 15, 2016 on management of medical equipment;
At the request of Director of Medical Equipment and Work Department;
The Minister of Health hereby promulgates a Circular to promulgate the nomenclature of medical equipment whose HS codes have been assigned in the Vietnam’s nomenclature of exports and imports.
Article 1. Promulgation of the nomenclature
The nomenclature of medical equipment under the management of the Ministry of Health whose HS codes have been assigned in the Vietnam’s nomenclature of exports and imports (hereinafter referred to as “the Nomenclature”) is promulgated together with the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance.
Article 2. Use of the nomenclature
1. The Nomenclature includes products that have been classified as medical equipment and managed as prescribed in the Government’s Decree No. 36/2016/ND-CP dated May 15, 2016 on management of medical equipment, Circular No. 30/2015/TT-BYT dated October 12, 2015 of the Ministry of Health on import of medical equipment and other legislative documents about medical equipment.
2. The nomenclature of medical equipment whose HS codes have been assigned promulgated together with this Circular shall serve as a basis for making customs declaration upon export or import of medical equipment into Vietnam.
3. Upon import or export of medical equipment that has been granted the free-sale registration number or import license as prescribed but whose HS codes have yet to be included in the Nomenclature promulgated together with this Circular, customs declaration shall be made according to its description and Vietnam’s nomenclature of exports and imports. After clearance, the exporter/importer shall submit a report on such exported/imported medical equipment to the Ministry of Health (Medical Equipment and Work Department), which will cooperate with the Ministry of Finance (the General Department of Customs) to consider addition of such medical equipment to the Nomenclature.
4. In case of any difficulties or difference in assigning HS codes in the Nomenclature promulgated together with this Circular, the Ministry of Health (Medical Equipment and Work Department) shall cooperate with the Ministry of Finance (the General Department of Customs) in considering reaching an agreement according to the rules specified in Clause 4 Article 19 of the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 to facilitate clearance, and propose amendments to the nomenclature.
In the cases where any of the legislative documents and regulations referred to in this Circular is amended, replaced or annulled, the newest one shall apply.
1. This Circular comes into force from July 01, 2018.
2. The nomenclature in the Appendix I enclosed with the Circular No. 30/2015/TT-BYT dated October 12, 2015 of the Minister of Health is null and void from the effective date of this Circular.
Article 5. Responsibility for implementation
Director of Medical Equipment and Work Department, Chief of the Ministry Office, Chief Inspector of Ministry, Directors of Departments, heads of affiliates of the Ministry of Health, Departments of Health of provinces and central-affiliated cities, health authorities, organizations and individuals related to import and export of medical equipment and other relevant organizations and individuals are responsible for the implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be promptly reported to the Medical Equipment and Work Department (the Ministry of Health) for consideration./.
